Using takt.

These Terms of Service apply when you access or use takt., including its consumer app, website, Backstage venue tools, public pages, widgets, feeds, event distribution tools, and related beta services.

takt. is operated by Tommy Szewczuk, Max-Brauer-Allee 8, 22765 Hamburg, Germany. Contact: takt@merou.de. Full operator information is available in the Legal notice.

Every account-creation flow requires you to explicitly accept the current version of these terms. takt. records the accepted document version and acceptance time. If you act for a venue, promoter, organization, or other business, you must be at least 18 years old and also confirm that you are authorized to accept these terms and manage the relevant content and connected accounts on its behalf.

You must provide accurate account information, keep your sign-in credentials secure, and promptly notify takt. if you believe your account or a connected business destination has been accessed without permission.

Consumer accounts do not require you to confirm a minimum age. You must be at least 18 years old to claim a venue or use venue-owner business tools.

Beta, TestFlight, and closed Google Play access may be limited, changed, or withdrawn while features are being tested. An invitation or approved beta application does not guarantee permanent access, uninterrupted availability, or a specific future feature set.

You remain responsible for event, venue, profile, media, message, and campaign content that you submit or authorize takt. to distribute. You confirm that the content is accurate, lawful, and that you hold the rights and permissions needed to use it.

You grant takt. a non-exclusive, worldwide, royalty-free licence to host, format, reproduce, display, and distribute that content only as needed to operate takt. and publish it to the destinations you select. This licence ends when the content is deleted, except where limited retention is required for backups, audit records, dispute handling, security, or legal obligations.

Connecting Facebook, Instagram, WhatsApp Business, Google Business Profile, or another provider authorizes takt. to use the permissions granted through that provider to perform the actions you enable. You must have authority over the selected Page, professional account, phone number, Business Profile, audience, and other business assets.

WhatsApp recipients must have provided the opt-in required for the message being sent. Venue operators are responsible for the accuracy and provenance of their recipient consent, approved templates, and audience selection.

External providers apply their own terms, policies, technical limits, review decisions, and charges. Disconnecting a provider disables future takt. publishing but does not necessarily remove content already published on that provider.

You must not use takt. to:

• publish unlawful, misleading, infringing, discriminatory, abusive, or fraudulent content;
• impersonate another person, venue, business, or account owner;
• send unsolicited messages or use recipient data without the required consent;
• bypass access controls, provider permissions, moderation, publication review, or rate limits;
• interfere with the service, introduce malicious code, scrape protected data, or attempt unauthorized access; or
• use takt. in a way that violates applicable law or the rules of a connected provider.

takt. may remove content, pause destinations, restrict features, or suspend accounts where reasonably necessary to protect users, venues, providers, or the service, investigate a suspected violation, or comply with law.

takt. provides discovery and publishing tools, but venue details, event schedules, prices, availability, entry rules, and third-party posts may change. Confirm time-sensitive information with the venue or event organizer before relying on it.

takt. may maintain, update, replace, or discontinue features. Planned maintenance, provider outages, beta changes, security incidents, and circumstances outside reasonable control may temporarily affect availability.

Liability is unlimited for intent and gross negligence, injury to life, body, or health, guarantees expressly given, fraudulent concealment, and liability required by applicable product-liability law. For ordinary negligence involving an essential contractual obligation, liability is limited to the foreseeable loss typical for this agreement. Otherwise, liability for ordinary negligence is excluded to the extent permitted by law. Mandatory consumer rights remain unaffected.

You may stop using takt. and disconnect provider accounts at any time. Account deletion is available through the app with the displayed recovery period. takt. may terminate or restrict access for a material or repeated breach, a security risk, a legal requirement, or discontinuation of the service. Where appropriate, reasonable notice will be provided.

German law applies, excluding its conflict-of-law rules, while mandatory protections of your country of residence remain unaffected if you are a consumer. Statutory rules govern the competent courts.

Material changes to these terms will be communicated through the service or the account contact information where reasonably possible. When takt. publishes a new terms version, you must explicitly accept that version before you can submit, publish, edit, message, or upload user or business content again. Continued use alone does not record acceptance.
